for the PFL GatorJax club

Notice: Public Forum Limited website "gatorjax" is voluntarily and Proudly Regulated by: ofcom: office for communications and media and ICO: information commissioner’s office.

ofcom and ico regulate and enforce:

1, the Public Forum Limited Company’s' operating policies, practices and legal obligations and compliance.

2, enforce your legal protections for online use and personal information.

These terms and conditions ("Terms", "Agreement") are an agreement between Public Forum Limited ("Website Operator", "us", "we" or "our") and you ("User", "you" or "your") (Website Operator Subscription fees and Service fees “pfl-fees”). This Agreement sets forth the general terms and conditions of your use of the Website Operator www.gatorjax.com website and any of its products or services (collectively, "Website" or "Services").

Notice: People under the age of 18 must obtain permission from parents or legal guardian prior to joining gatorjax.com. This is because persons under 18 years of age are not permitted to enter into and sign financial agreements.

Website Operator of gatorjax.com is a paid for service. All money paid ( 'pfl-fees' ) is for the employment of staff, running costs and company development.

Warnings and Account/MembershipTerminations are tiered as follows:

Level 1 Warning - No account restrictions are implemented. A simple message to highlight the rule a user has broken. This is usually issued as a first notice for users who haven't been warned previously or if the rule break isn't severe.

Level 2 Warning - Account is restricted. Unable to make new threads temporarily and posts are limited to once per 150 seconds. This may be issued if, for example, a previous warning has been given, for repeated infractions, if the post in question is severe in nature, or if the warning is based on an unproductive thread the user has made.

Level 3 Warning - Account is temporarily banned. If a user repeatedly breaks the rules we may temporarily revoke their posting privileges. Temporary bans may be 48 hours, 7 days or 14 days. This is usually dependent on the amount of previous warnings and the severity of the infractions. We understand that sometimes our members may just need some time away to reflect on their posts and hopefully with a break they can return with a better understanding of the Community Guidelines.

Level 4 Action - Permanent Ban/termination of account/membership - Account is permanently banned and the user will no longer be able to use their account. For example, if a user has received numerous warnings but persists to break the rules a permanent ban/termination will be issued. A user may also receive a permanent ban/termination for really severe infractions that are highlighted above as zero tolerance. It's compulsory for every user to adhere to these guidelines.

These tiers are not exhaustive and we retain full discretion to manage threads, the services and the site as we deem appropriate.

Accumulating all warning levels may lead to the termination of your account/membership the next time you are warned. A temporary ban will only be issued in circumstances where it's deemed appropriate and a user could be permanently banned/terminated without ever receiving a temporary ban.

In the event that your membership/account is terminated due to violating Website Operator Terms and rules then there will be no refund of “pfl-Fees”.

Personal Information

( Public Forum Ltd is registered with the ‘Information Commissioners Office’ UK)

Public Forum Ltd Collects personal information such as, Name, Address, Phone number and E-mail address, Identity submitted information (for proof of identity).

This information is not visible on your membership account. No other member can see this information.

The only people that can see your information are our Security and Admin team and UK Police forces should they request it.

We use this information to verify all members and better protect members.

In the case of legal issues Public Forum Ltd will share this information with Police forces and other Government agencies.

Deletion, Account/Membership Termination

( Terminating or pausing of a members account by Security or Admin Team )

If Website Operator Security or Admin team have reason to close, delete, terminate your account/membership due to breaking of the Terms for any reason, Then any and all “pfl-fees” will not be refunded. Website Operator will end subscription payments from you but also you 'the member' must also cancel your subscription payments via your bank or PayPal account. Any money received after the cancelation date will be refunded and only refunded from the bank account from which “pfl-fees” where paid out and also proof of payment from after such date of action be provided.

Accounts and Membership

You must be at least 18 years of age to use this Website. By using this Website and by agreeing to this Agreement you warrant and represent that you are at least 18 years of age. If you create an account/membership on the gatorjax.com Website, you are responsible for maintaining the security of your account/membership and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it. We may, but have no obligation to, monitor and review new accounts before you may sign in and use our Services. Providing false contact information of any kind may result in the termination of your account/membership. You must immediately notify us of any unauthorised uses of your account/membership or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. We may suspend, terminate your account/membership (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill. If we terminate your account/membership for the foregoing reasons, you may not re-register for our Services. We may block your email address, mobile phone number and ISP Internet protocol address to prevent further registration.

Abuse

Public Forum Ltd Security team have ZERO TOLERENCE when it comes to abuse. If you are being affected by Abuse of any Kind whilst on gatorjax.com please notify us immediately. Our admin or security will investigate and the abuser Will have their account/membership terminated. Also the account/membership interactions/data will be retained for legal reasons.

There is NO appealing this decision.

Freedom of Speech (freedom of expression)

Members are required to ensure that:

"Freedom of speech/expression" not be used to:

a, harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.

b, to submit false or misleading information.

c, Be used to vent a personal vendetta against any person, group or business. Any such grievance must be taken to the proper legal authorities or Law Enforcement to investigate.

d, PFL Security will, if found or reported to, will remove such violations and or create a case file and handed to the relevant Legal Authorities that may use such violations in a court of law.

e, Members who violate these terms may have their account/membership terminated.

f, Remember, Gatorjax is a family site. Please respect it, Gatorjax membership is a privilege, not a legal right.

User content

We do not own any data, information or material ("Content") that you submit on the Website in the course of using the Service. You shall have sole responsibility for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use of all submitted Content. We may, but have no obligation to, monitor and review Content on the Website submitted or created using our Services by you. Unless specifically permitted by you, your use of the Website does not grant us the license to use, reproduce, adapt, modify, publish or distribute the Content created by you or stored in your user account for commercial, marketing or any similar purpose. But you grant us permission to access, copy, distribute, store, transmit, reformat, display and perform the Content of your user account solely as required for the purpose of providing the Services to you. Without limiting any of those representations or warranties, we have the right, though not the obligation, to, in our own sole discretion, refuse or remove any Content that, in our reasonable opinion, violates any of our policies or is in any way harmful or objectionable or violates any laws of any nation.

Adult content

Please be aware that there may be certain adult, mature content, illegal content and content that violates our Terms available on the Website. Where there is such content, pfl security, admin or moderator team will remove/delete such content immediately on being aware. Also individuals who post such content will have their account/membership terminated and all actions, interactions performed will be kept/stored on file and may be used in legal actions.

Backups

We are not responsible for Content residing on the Website. In no event shall we be held liable for any loss of any Content. It is your sole responsibility to maintain appropriate backup of your Content. Notwithstanding the foregoing, on some occasions and in certain circumstances, with absolutely no obligation, we may be able to restore some or all of your data that has been deleted as of a certain date and time when we may have backed up data for our own purposes. We make no guarantee that the data you need will be available.

Links to other websites

Although this Website may link to other websites, we are not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked website, unless specifically stated herein. Some of the links on the Website may be “business member links” or "affiliate links". This means if you click on the link and purchase an item or visit a website, Website Operator may or will receive an affiliate commission. We are not responsible for examining or evaluating, and we do not warrant the offerings of any businesses or individuals or the content of their websites. We do not assume any responsibility or liability for the actions, products, services, and content of any other third-parties, their websites or services. Prohibited uses

In addition to other terms as set forth in the Agreement, you are prohibited from using the Website or its Content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to dext, spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. Prohibited Users

Persons, groups, companies/businesses, agents of or otherwise named or described as religious groups, organisations, cults, or otherwise named, identified or described.

Also prohibited are Psychics, Mediums, Clairvoyants, Tarot readers, witch Doctors or otherwise named or self-described are not welcome to create accounts on gatorjax.com.

Also the selling, marketing, advertising for sale, trade or given away free of charge is not permitted and neither is placing links, blogs, information or other media posts that encourage members to leave gatorjax.com website to other websites, groups, companies or persons in order to promote the sale or trade of such services, potions, spells or other items, products, information, religious information or teachings, media, books, items, regardless of self-proclaimed rights or legal rights to do so.

Also prohibited are: persons or companies, agents, affiliates, influencers or otherwise described for the purpose of selling, promoting, trading, influencing the use of pharmaceuticals , medication, drugs or otherwise described, Dieting/weight loss products, services or procedures. Also the sales, promotion, influencing, services or otherwise described the sale of products, goods, equipment, services, companies, groups, websites that promote or otherwise described, body dysmorphia, anorexia, bulimia, cosmetic procedures, surgical procedures or any other product, system or procedure.

Influencers, Promoters and Advisors

If you are an ‘Influencer’ ‘Promoter’ or an ‘Advisor’ or otherwise self-described, it is a requirement of Website Operator and in some cases a Legal Requirement that ‘You’ be Fully Trained, Certified and Registered and that all related qualifications and registrations can be fully independently checked and verified by Website Operator Security Team.

Also, any and all Advertisements, postings, comments be in line with the rules and regulations of the Advertising Standards Authority of the UK and also must fully comply with the regulations and Laws of the United Kingdom. This policy does not free you from any legal laws or obligations of your home nation in regards to advertising, promoting, influencing or advising. In such cases you are fully legally bound and obligated to adhere to the laws and regulations of your home nation.

Intellectual property rights

This Agreement does not transfer to you any intellectual property owned by Website Operator or third-parties, and all rights, titles, and interests in and to such property will remain (as between the parties) solely with Website Operator. All trademarks, service marks, graphics and logos used in connection with our Website or Services, are trademarks or registered trademarks of Website Operator or Website Operator licensors. Other trademarks, service marks, graphics and logos used in connection with our Website or Services may be the trademarks of other third-parties. Your use of our Website and Services grants you no right or license to reproduce or otherwise use any Website Operator or third-party trademarks.

Freedom of Speech (freedom of expression)

Article 10 (freedom of expression)

This Article shall not prevent States from requiring the licensing of broadcasting, television or cinema enterprises.

2, The exercise of these freedoms, since it carries with it duties and responsibilities, may be subject to such formalities, conditions, restrictions or penalties as are prescribed by law and are necessary in a democratic society, in the interests of national security, territorial integrity or public safety, for the prevention of disorder or crime, for the protection of health or morals, for the protection of the reputation or rights of others, for preventing the disclosure of information received in confidence, or for maintaining the authority and impartiality of the judiciary.

PFL : Gatorjax also require that:

Members must not "write/post comments", "pass on or spread posts or comments", "Incite others to act in a manner that is unlawful or Immoral"

Members are required to ensure that:

1, All information, Comments, Posts, Videos are based on checkable and provable "Fact". In a manner that it would be classed as "Trusted Evidence" in a court of Law.

2, Comments/Posts must not be used to abuse , harm, be classed as liable, Harm emotionally/physically or incite others to act or add comments or posts that it would prolong the above mentioned violations.

3, Freedom of speech must not be used to make claims "False or True" against any person, group or business. If any member has actual grievances then it is required that members must take their grievances to the proper legal systems or law enforcement to investigate.

4, Freedom of Speech on pfl GatorJax is subject to pfl security allowances. If violations are found or reported, they will be checked and if found to violate our terms of service or violate morals then the member/account may be terminated or passed on to Law Enforcement for further investigation.

5, Remember, GatorJax is a family site. We love morals and freedom of speech/expression.

Limitation of liability

To the fullest extent permitted by applicable law, in no event will Website Operator, its affiliates, officers, directors, employees, agents, suppliers or licensors be liable to any person for (a): any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if Website Operator has been advised as to the possibility of such damages or could have foreseen such damages. To the maximum extent permitted by applicable law, the aggregate liability of Website Operator and its affiliates, officers, employees, agents, suppliers and licensors, relating to the services will be limited to an amount greater of one pound or any amounts actually paid in cash by you to Website Operator for the prior one month period prior to the first event or occurrence giving rise to such liability. The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails of its essential purpose.

Indemnification

You agree to indemnify and hold Website Operator and its affiliates, directors, officers, employees, and agents harmless from and against any liabilities, losses, damages or costs, including reasonable legal' fees, incurred in connection with or arising from any third-party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Website or Services or any wilful misconduct on your part.

Severability

All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid or unenforceable. If any provision or portion of any provision of this Agreement shall be held to be illegal, invalid or unenforceable by a court of competent jurisdiction, it is the intention of the parties that the remaining provisions or portions thereof shall constitute their agreement with respect to the subject matter hereof, and all such remaining provisions or portions thereof shall remain in full force and effect.

Dispute resolution

The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of the United Kingdom without regard to its rules on conflicts or choice of law and, to the extent applicable, the laws of the United Kingdom. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in the United Kingdom, and you hereby submit to the personal jurisdiction of such courts. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.

Changes and amendments

We reserve the right to modify this Agreement or its policies relating to the Website or Services at any time, effective upon posting of an updated version of this Agreement on the Website. When we do, we will revise the updated date at the bottom of this page. Continued use of the Website after any such changes shall constitute your consent to such changes. Acceptance of these terms

You acknowledge that you have read this Agreement and agree to all its terms and conditions. By using the Website or its Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorised to use or access the Website and its Services.

Assignment

You may not assign, resell, sub-license or otherwise transfer or delegate any of your rights or obligations hereunder, in whole or in part, without our prior written consent, which consent shall be at our own sole discretion and without obligation; any such assignment or transfer shall be null and void. We are free to assign any of its rights or obligations hereunder, in whole or in part, to any third party as part of the sale of all or substantially all of its assets or stock or as part of a merger.

Public Forum Security

(Website Operator Security operate a Zero Tolerance Policy)

Website Operator Security have full autonomy in relation to upholding and enforcing the Terms of Service, Privacy Policy, Member Conduct and any and all matters in relation to member security and safety, site security and liaising with Law Enforcement Authorities and other Government Agencies as required.

Also Website Operator Security have full autonomy and authorisation to take any action as deemed necessary in the application of its duties to protect, enforce and secure. Also gather member Information, posts, content and other media information that is deemed important in compiling files that may be used in Legal matters or requested by Law Enforcement agencies or government agencies.

The decisions made by Website Operator Security are final. There is no appealing or overturning their decision.

Refunds

1, In the event that your membership/account is terminated/deactivated or deleted due to violating Website Operator Terms then there will be no refund of “pfl-Fees”.

2, Any “pfl-fees” refundable deemed acceptable and proper will be only paid back into bank accounts from which the “pfl-fees” were accepted / paid from.
